  • Feel free to share your weed—but not if the recipient is younger than the legal age to enjoy it. And remember: a gift is a gift! The law says you can’t sell it unless you have a license.
  • If you’re at least 21, you can buy, keep, and enjoy about an ounce (28.5 grams) of flower or 8 grams of cannabis concentrate.

Where Can You Enjoy Cannabis?

  • There’s pretty much a single answer for this one: You can enjoy cannabis on private property in California. That said, a property owner or landlord can legally ban cannabis on properties they own.
  • The law is pretty clear. Therefore, smoking, vaping, or sampling edibles is not allowed on public streets, sidewalks, parks, etc. Basically, if you can’t smoke a tobacco product somewhere, you can’t partake in cannabis there, either. Federal land is off-limits, too, since it’s under federal law, which doesn’t view cannabis the same way as the state.
  • Keep packages and containers closed if you’re out and about. Even if you’re not smoking it, you can’t open a package in public.
  • You can enjoy cannabis in other states where recreational marijuana use is legal—but you can’t bring yours with you on a trip from California. Keep it within state lines.
  • If you are driving somewhere within the state, your cannabis has to be in an approved and sealed container or else in the trunk. This is true whether you’re the driver or a passenger.
  • It should go without saying, but never drive while under the influence of marijuana (or anything else, for that matter). Safety first! It’s not just the law—it’s a good idea!
